What must a Colorado Child and Family Investigator's report include?

Under Chief Justice Directive 04-08, a Colorado Child and Family Investigator report must include an itemized account of the Colorado Child and Family Investigator's time and services, findings tied to the evidence gathered, the legal standard applied, and the child's stated wishes, even where the Colorado Child and Family Investigator recommends something different. A Colorado Child and Family Investigator report is not required to address every facet of the investigation the way a full Parental Responsibilities Evaluation does.

Can a Colorado Child and Family Investigator be subpoenaed to testify in a Colorado family law case?

CJD 04-08 does not set out a Colorado Child and Family Investigator-specific compulsion mechanism, though it acknowledges parties may request the Colorado Child and Family Investigator's testimony or the court may order it. The appointment order (JDF 1318) also asks the court up front whether the Colorado Child and Family Investigator is directed to attend. Otherwise, a Colorado Child and Family Investigator can generally be compelled to testify the same way any witness can, through the ordinary subpoena process for the case.

What is the difference between direct and cross-examination of a Colorado Child and Family Investigator?

CJD 04-08 Standard 3 preserves ordinary direct and cross-examination of a Colorado Child and Family Investigator if the Colorado Child and Family Investigator testifies at trial. Whichever side calls the Colorado Child and Family Investigator to the stand questions first on direct examination, and the opposing side then cross-examines.

Q: Does a Colorado Child and Family Investigator's appointment end when the report is filed?

Not automatically. CJD 04-08 sets an outer boundary that the appointment shall not terminate later than entry of permanent orders, but the actual order of appointment (form JDF 1318) lets the judge check an earlier end point, including upon filing of the Colorado Child and Family Investigator report. Whether a given Colorado Child and Family Investigator's role ends at the report depends on what was checked on that specific order.

Q: How do I file a complaint against a Colorado Child and Family Investigator?

A judicial officer must first make preliminary findings on the record before a state complaint against a Colorado Child and Family Investigator can be filed, and the Colorado Child and Family Investigator has 21 days to respond before that happens. A complaint filed without that step, or more than six months after the Colorado Child and Family Investigator's appointment ends, is denied automatically, as is a complaint that amounts to disagreement with a recommendation rather than a violation of the directive. Preliminary findings should be requested within 60 days after the appointment ends, ideally before final orders. One narrow exception skips the preliminary-findings requirement: a Child and Family Investigator's failure to disclose to SCAO a malpractice suit, criminal charge, or pending grievance or discipline.

Q: Can I object to a Colorado Child and Family Investigator before they are appointed to my case?

Yes. Under C.R.S. 14-10-116.5(2.5)(b), after a proposed Child and Family Investigator discloses any familial, financial or social relationship with the child, the parties, their lawyers or the judicial officer, a party has seven days from the disclosure to object based on that disclosure; the court then confirms the appointment or appoints someone else.

The Colorado Child and Family Investigator, in plain English

Testing authority, straight: a Colorado Child and Family Investigator can recommend that the court order drug testing or a substance-abuse or mental-health evaluation — but a Colorado Child and Family Investigator cannot order it and cannot perform psychological testing. If real diagnostic testing is needed, the tool is a PRE (JDF 1331 / JDF 1332), and only a qualified mental-health professional (in this directory, a psychologist / “PSY”) can do it. Colorado currently lists just 2 psychologist investigators statewide.

Can’t afford a Colorado Child and Family Investigator? How to get one state-paid

Cost should not decide your children’s case. If you qualify as indigent, the State of Colorado pays the Colorado Child and Family Investigator’s fee under CJD 04-05. Here is the path, start to finish:

Ask for the Colorado Child and Family Investigator. File a JDF 1317 (or agree with the other side) requesting the appointment.
Apply for state payment. File the JDF 208 — this is the indigency application. The court weighs your income and assets against the state guidelines.
Pick from the state-paid roster. Only Colorado Child and Family Investigators who accept state-paid work can be assigned — 111 of 151 in the directory above do. Filter for “State-paid OK.”
The judge signs the JDF 1318 setting the scope and the state-pay allocation. In a divorce or legal separation before the decree, the state pays only if both spouses are found indigent on their combined income and assets (§ 14-10-116.5(3)(b)); in custody cases between unmarried parents and in post-decree cases, the court may split the cost so the state pays only an indigent party’s share (§ 14-10-116.5(3)(c)).
Know the tradeoff: state-paid Colorado Child and Family Investigators are in high demand and the state rate is lower, so availability can be tighter — apply early.

What Changed in 2023, 2024 and 2026 — and Why It Still Matters

Chief Justice Directive 04-08 was substantially rewritten effective June 29, 2023: the private-pay presumptive cap rose to $3,250, a state complaint now requires preliminary judicial findings first, mixed-pay fee calculation was clarified, and the roster renewal cycle went from two years to five. A 2024 amendment (effective August 7, 2024) added licensed legal professionals to the Standard 2 disclosure and updated Standards 6 and 15. An amendment effective August 26, 2026 raised the presumptive cap to $3,309 for appointments made after that date and added AI/GenAI rules and a Title 14 legal-standards training requirement (beginning January 1, 2027). Child and Family Investigator domestic-violence training follows C.R.S. § 14-10-127.5, as amended.

None of it is retroactive — but if your Child and Family Investigator was appointed before June 29, 2023 (or before a later amendment date), it's worth asking which version of the rules governed their file.

How to File a Complaint Against a Colorado Child and Family Investigator — and the Mistakes That Get One Denied Automatically

The real process has a trap: a judicial officer must first make preliminary findings on the record before a state complaint can even be filed, and the Colorado Child and Family Investigator gets 21 days to respond before that happens. File without that step, or more than six months after the Colorado Child and Family Investigator's appointment ends, and the complaint is denied automatically — as is one that's really just disagreement with a recommendation rather than a directive violation.

Request preliminary findings within 60 days after the appointment ends (ideally before final orders), and file the SCAO complaint within six months after the appointment ends. One narrow exception skips the preliminary-findings step: a Child and Family Investigator's failure to disclose to SCAO a malpractice suit, criminal charge, or pending grievance or discipline.

Who's Actually Qualified to Investigate Your Family — Colorado Child and Family Investigator Training Requirements

Getting on the roster requires a background check, a Colorado Child and Family Investigator Affidavit, at least 20 hours of initial domestic-violence and child-abuse training, and 10 more hours across child development, high-conflict dynamics, substance abuse, and interviewing technique. Since the June 29, 2023 revision, renewal is every five years, with 10 hours of continuing education plus 15 more hours specifically on domestic violence and child abuse.

Child and Family Investigator Fee Guide — What a Family Actually Pays

For state-paid appointments, CJD 04-05 (effective August 1, 2025) sets $110 per hour for both attorney and non-attorney Colorado Child and Family Investigators, with a maximum total fee of $3,309 per appointment. For private-pay appointments made after August 26, 2026, CJD 04-08 sets a presumptive cap of $3,309 plus up to $500 for testimony. A Child and Family Investigator is not required to release the report until paid in full unless the investigator agrees otherwise (CJD 04-08, Court Standard C).

You Can Object to a Colorado Child and Family Investigator Before They're Even Appointed

Under C.R.S. §14-10-116.5(2.5)(b), after a proposed Child and Family Investigator discloses any familial, financial or social relationship with the child, the parties, their lawyers or the judicial officer, a party has seven days from the disclosure to object based on that disclosure; the court then confirms the appointment or appoints someone else. A 2024 amendment (effective August 7, 2024) added licensed legal professionals of record to those who must receive the investigator’s JDF 1338 disclosure.

This window is short — seven days from the disclosure — which is exactly why the next section matters.

The court order controls

Your Colorado Child and Family Investigator's Order of Appointment Controls Everything Below — Read It First

Scope isn't a template.
CJD 04-08 requires the order of appointment to “clearly set forth the subject matter and scope of the Colorado Child and Family Investigator's duties,” and the Colorado Child and Family Investigator is separately required to review that order and ask the court for clarification if it's unclear. Two Colorado Child and Family Investigators on two different cases can genuinely have different jobs.

Does it end at the report?
The default outer boundary is that the appointment “shall not terminate later than entry of permanent orders” — but the order itself (JDF 1318) lets the judge check an earlier end-point, including “upon filing the Colorado Child and Family Investigator report with the Court.” Which one applies depends on what was checked on your order, not a statewide default.

CJD 04-08 doesn't spell out a Colorado Child and Family Investigator-specific compulsion mechanism; it acknowledges parties may request testimony or the court may order it. JDF 1318 itself asks the court up front whether the Colorado Child and Family Investigator is directed to attend. In practice a Colorado Child and Family Investigator can otherwise be compelled the same way any witness is — the ordinary subpoena process for the case.
