The CFI, in plain English
When parents can’t agree on parenting time or decision-making — or when one side raises allegations a judge can’t sort out from the bench — the court appoints a neutral Child & Family Investigator (CFI) under C.R.S. § 14-10-116.5 to investigate and recommend what is in the children’s best interests. A CFI is deliberately a brief, non-intrusive, cost-capped investigation — not a deep clinical work-up. Understanding exactly what that means, and what it does not mean, is where most parents either protect their case or accidentally hurt it.

Who, how & why — and the lines a CFI can’t cross
✓ What a CFI CAN do
- Interview both parents, the children (age-appropriately), and collaterals — teachers, therapists, doctors, coaches.
- Do a home visit and review records the appointment order covers.
- Make specific written recommendations on parenting time, decision-making, and the best-interests factors in § 14-10-124.
- Recommend (to the court) drug testing, a substance-abuse evaluation, therapy, or a fuller psychological evaluation (a PRE).
- Testify at the hearing and be cross-examined on the report.
✗ What a CFI CANNOT do
- Order anything — only the judge orders. A CFI recommends; the court decides.
- Perform psychological testing or a full mental-health evaluation — that is a PRE’s job (§ 14-10-127). A CFI runs a brief assessment.
- Provide therapy to the family, mediate the case, or act as anyone’s lawyer (CJD 04-08, Standard 4 — dual-role ban).
- Take the case with a prior personal, financial, or social relationship to a party (must file a JDF 1338 within 7 days).
- Exceed the fee cap without a written court order for extraordinary circumstances.

Testing authority, straight: a CFI can recommend that the court order drug testing or a substance-abuse or mental-health evaluation — but a CFI cannot order it and cannot perform psychological testing. If real diagnostic testing is needed, the tool is a PRE (JDF 1331 / JDF 1332), and only a qualified mental-health professional (in this directory, a psychologist / “PSY”) can do it. Colorado currently lists just 2 psychologist-CFIs statewide.

Cost should not decide your children’s case. If you qualify as indigent, the State of Colorado pays the CFI’s fee under CJD 04-05. Here is the path, start to finish:
- Ask for the CFI. File a JDF 1317 (or agree with the other side) requesting the appointment.
- Apply for state payment. File the JDF 208 — this is the indigency application. The court weighs your income and assets against the state guidelines.
- Pick from the state-paid roster. Only CFIs who accept state-paid work can be assigned — 111 of 151 in the directory below do. Filter for “State-paid OK.”
- The judge signs the JDF 1318 setting the scope and the state-pay allocation. If only one parent is indigent, the court can split the cost; both parents state-paid only if both are found indigent (§ 14-10-116.5(3)(b)).
- Know the tradeoff: state-paid CFIs are in high demand and the state rate is lower, so availability can be tighter — apply early.
