The CFI, in plain English
When parents can’t agree on parenting time or decision-making — or when one side raises allegations a judge can’t sort out from the bench — the court appoints a neutral Child & Family Investigator (CFI) under C.R.S. § 14-10-116.5 to investigate and recommend what is in the children’s best interests. A CFI is deliberately a brief, non-intrusive, cost-capped investigation — not a deep clinical work-up. Understanding exactly what that means, and what it does not mean, is where most parents either protect their case or accidentally hurt it.

Who, how & why — and the lines a CFI can’t cross
✓ What a CFI CAN do
- Interview both parents, the children (age-appropriately), and collaterals — teachers, therapists, doctors, coaches.
- Do a home visit and review records the appointment order covers.
- Make specific written recommendations on parenting time, decision-making, and the best-interests factors in § 14-10-124.
- Recommend (to the court) drug testing, a substance-abuse evaluation, therapy, or a fuller psychological evaluation (a PRE).
- Testify at the hearing and be cross-examined on the report.
✗ What a CFI CANNOT do
- Order anything — only the judge orders. A CFI recommends; the court decides.
- Perform psychological testing or a full mental-health evaluation — that is a PRE’s job (§ 14-10-127). A CFI runs a brief assessment.
- Provide therapy to the family, mediate the case, or act as anyone’s lawyer (CJD 04-08, Standard 4 — dual-role ban).
- Take the case with a prior personal, financial, or social relationship to a party (must file a JDF 1338 within 7 days).
- Exceed the fee cap without a written court order for extraordinary circumstances.

Testing authority, straight: a CFI can recommend that the court order drug testing or a substance-abuse or mental-health evaluation — but a CFI cannot order it and cannot perform psychological testing. If real diagnostic testing is needed, the tool is a PRE (JDF 1331 / JDF 1332), and only a qualified mental-health professional (in this directory, a psychologist / “PSY”) can do it. Colorado currently lists just 2 psychologist-CFIs statewide.
💰 Can’t afford a CFI? How to get one state-paid
Cost should not decide your children’s case. If you qualify as indigent, the State of Colorado pays the CFI’s fee under CJD 04-05. Here is the path, start to finish:
- Ask for the CFI. File a JDF 1317 (or agree with the other side) requesting the appointment.
- Apply for state payment. File the JDF 208 — this is the indigency application. The court weighs your income and assets against the state guidelines.
- Pick from the state-paid roster. Only CFIs who accept state-paid work can be assigned — 111 of 151 in the directory below do. Filter for “State-paid OK.”
- The judge signs the JDF 1318 setting the scope and the state-pay allocation. If only one parent is indigent, the court can split the cost; both parents state-paid only if both are found indigent (§ 14-10-116.5(3)(b)).
- Know the tradeoff: state-paid CFIs are in high demand and the state rate is lower, so availability can be tighter — apply early.

What Changed in 2024 — and Why It Still Matters
On August 7, 2024, Colorado quietly rewrote the rules for every CFI in the state under Chief Justice Directive 04-08. Five changes affect a case today: the presumptive fee cap rose (to $3,250, then to $3,309 by August 2025); a state complaint against a CFI now requires preliminary judicial findings before it can even be filed; the CFI renewal cycle stretched from two years to five; training shifted to track the new C.R.S. §14-10-127.5; and “licensed legal professionals” were added to the conflicts a CFI must disclose up front.
None of it is retroactive — but if your CFI was appointed before August 2024, it's worth asking which version of the rules governed their file.
What Your CFI's Report Must Legally Include — a Checklist
CJD 04-08 specifies the minimum contents of a CFI report. One line is worth knowing before you read your own: a CFI report “need not address every facet of the investigation” the way a full PRE evaluation does — so measure it against this list, not against a standard you assume it should meet.

The deadline is real — absent a different court-set date, a CFI report is due at least 35 days before trial, and CJD 04-08 preserves your right to cross-examine the CFI directly if they testify, so a rebuttal built in advance is what gives that cross-examination something to aim at.
How to File a Complaint Against a CFI — and the Mistakes That Get One Denied Automatically
The real process has a trap: a judicial officer must first make preliminary findings on the record before a state complaint can even be filed, and the CFI gets 21 days to respond before that happens. File without that step, or more than six months after the CFI's appointment ends, and the complaint is denied automatically — as is one that's really just disagreement with a recommendation rather than a directive violation.
Two narrow exceptions skip the preliminary-findings step: an undisclosed malpractice suit, criminal charge, or prior grievance, and Standard 6 training violations.
Who's Actually Qualified to Investigate Your Family — CFI Training Requirements
Getting on the roster requires a background check, a CFI Affidavit, at least 20 hours of initial domestic-violence and child-abuse training, and 10 more hours across child development, high-conflict dynamics, substance abuse, and interviewing technique. Renewal is now every five years, with 10 hours of continuing education plus 15 more hours specifically on domestic violence and child abuse.

2025 CFI Fee Guide — What a Family Actually Pays
As of August 1, 2025, both attorney and non-attorney CFIs bill $110 per hour, capped at $3,309 per appointment — up from the $3,250 cap the 2024 amendment set just a year earlier. A CFI can lawfully withhold the finished report until paid, unless the parties agree otherwise.

You Can Object to a CFI Before They're Even Appointed
Under C.R.S. §14-10-116.5(2.5)(b), a party who believes a proposed CFI has an actual conflict of interest — or even just the appearance of impropriety — can file a timely objection in the trial court before the appointment takes effect. The 2024 amendment strengthened this further by adding licensed legal professionals to the conflicts a CFI must disclose up front.
This window closes fast once an order of appointment is signed — which is exactly what the next section is about.
Your CFI's Order of Appointment Controls Everything Below — Read It First
CJD 04-08 requires the order of appointment to “clearly set forth the subject matter and scope of the CFI's duties,” and the CFI is separately required to review that order and ask the court for clarification if it's unclear. Two CFIs on two different cases can genuinely have different jobs.
The default outer boundary is that the appointment “shall not terminate later than entry of permanent orders” — but the order itself (JDF 1318) lets the judge check an earlier end-point, including “upon filing the CFI report with the Court.” Which one applies depends on what was checked on your order, not a statewide default.
CJD 04-08 doesn't spell out a CFI-specific compulsion mechanism; it acknowledges parties may request testimony or the court may order it. JDF 1318 itself asks the court up front whether the CFI is directed to attend. In practice a CFI can otherwise be compelled the same way any witness is — the ordinary subpoena process for the case.
CJD 04-08 preserves ordinary “direct or cross-examination of the CFI if the CFI testifies.” Whichever side calls the CFI to the stand questions first (direct); the other side cross-examines. A rebuttal prepared in advance is what gives that cross-examination something specific to aim at.
