Retirement division is where paperwork is the whole game: the right order, to the right plan, at the right time — or someone loses money they were awarded.
Contributions and growth during the marriage are marital property — even in an account titled to one spouse, and even for a pension that won't pay for decades. Premarital balances stay separate (their growth may not).

A Qualified Domestic Relations Order is the separate court order that directs an employer retirement plan to pay a share to a former spouse. Without it, the decree alone moves nothing — and early withdrawals get taxed and penalized.
PERA is exempt from ERISA and follows its own statutes and procedures, using its own domestic relations order requirements (see JDF 1202). Deadlines and survivor-benefit elections are strict.
Usually not. Courts can still enter the QDRO or order contemplated by the decree, and truly omitted assets can support reopening — but delay creates risk, especially if the participant retires, remarries, or dies first.
A pension share without survivor benefits can die with the participant. Outstanding plan loans shrink the pot. Company stock inside a 401(k) has its own tax quirks. These details belong in the order — not discovered at retirement.
And a warning that saves marriages' worth of money: beneficiary forms beat wills and often beat decrees for employer plans under federal law. It's fixable — courts retain authority to enter the orders the decree contemplated, even years later. But every year of delay adds risk and mess. If your decree awarded retirement you never received, that's a this-month problem.
