Arrested in Aspen: what to do in the next hour

The next hour

1. Stay calm and do not resist. Keep your hands where officers can see them. Do not argue or run, even if you think the arrest is wrong.
2. You can stay silent. You may give your name if asked. Then you can say: “I want to remain silent. I want a lawyer.” After that, stop talking about what happened.
3. Ask for a lawyer, and keep asking. Do not explain, apologize, or try to talk your way out. Things you say can be used later.
4. Do not agree to searches. You can say: “I do not consent to a search.” Say it calmly and do not physically resist. Officers may still search in some situations; a lawyer can look at that later.
5. Be careful on the phone. Calls from jail are often recorded. Use calls to reach a lawyer, family, or a friend, not to talk about the facts.
6. Keep every paper you are given. Release paperwork usually shows a court date and conditions. Write the date down and do not miss it.
7. If you cannot afford a lawyer, tell the judge. You may be able to get a public defender.
